1. Acceptance of Terms

By accessing or using Ocean Compliance AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. The Service is operated by Ocean Compliance AI and is intended for use by maritime industry professionals, legal practitioners, and businesses engaged in ocean transportation.

2. Description of Service

Ocean Compliance AI provides an artificial intelligence-powered platform designed to assist users in understanding and navigating U.S. ocean transportation regulations, including rules and regulations of the Federal Maritime Commission (FMC), statutes enacted by the U.S. Congress relating to ocean transportation, and related legal and regulatory materials. The Service includes an AI chat interface, document upload and analysis capabilities, and access to a curated regulatory knowledge base.

THE INFORMATION PROVIDED BY OCEAN COMPLIANCE AI IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL ADVICE, LEGAL OPINION, OR THE PRACTICE OF LAW.

The AI-generated responses are based on publicly available regulatory materials and are not a substitute for advice from a qualified maritime attorney or compliance professional. You should not rely solely on the Service for compliance decisions. Always consult qualified legal counsel for specific compliance questions, disputes, or regulatory filings. Ocean Compliance AI expressly disclaims any liability for actions taken or not taken based on information provided through the Service.

4. Subscription and Payment

Access to the full Service requires a paid subscription. Subscription fees are charged on a monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

New accounts receive five (5) complimentary AI queries as a free trial. No credit card is required for the free trial. Upon exhaustion of trial queries, a paid subscription is required to continue using the AI assistant.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

6. Document Uploads and Data

You may upload documents to the Service for AI-powered analysis. By uploading documents, you represent that you have the right to share such documents and that they do not contain information that is subject to confidentiality obligations that would prohibit their submission to a third-party AI service. We process uploaded documents solely to provide the Service to you. Documents are stored securely and are not shared with other users.

7. Intellectual Property

The Service, including its software, design, and content (excluding user-uploaded documents and publicly available regulatory materials), is owned by Ocean Compliance AI and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from the Service without express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCEAN COMPLIANCE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO REGULATORY PENALTIES, FINES, OR LEGAL COSTS INCURRED IN RELIANCE ON AI-GENERATED RESPONSES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the federal and state courts located in New York County, New York.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
